Webinar: Who is liable in the supply chain?
The German Supply Chain Due Diligence Act (LkSG) and a more far-reaching draft directive of the EU Commission impose comprehensive human rights and sustainability due diligence obligations on companies. The webinar hosted by the Stuttgart Chamber of Commerce sheds light on the fines, sanctions and civil liability which companies face in case of non-compliance with the new statutory obligations. In particular, the draft EU Directive on Corporate Sustainability Due Diligence involves additional liability risks for affected companies, because insufficient preventive or mitigation measures may lead to a civil liability of the companies. The new liability norms are particularly powerful because affected persons worldwide will be entitled to claim liability, and because directors and officers may also be liable for not adequately assessing human rights and sustainability risks in their management decisions. Even small and medium-sized businesses, which are exempted from the due diligence legislation, will not be free from liability risks as large companies seek to impose due diligence and liability obligations on their suppliers. Every company should therefore be well aware of the liability risks existing in the respective value chain.
